Estimated five (5) to six (6) years for smooth application

• Filing new patent application
• National Phase entry via PCT route within thirty (30) months from the earliest claimed priority date
  OR
• Patent application via Paris Convention route within twelve (12) months
• Formality check and preliminary examination
• Publication in the Thai Patent Gazette (publication fees to be paid within sixty (60) days of receiving Notice of Publication)
• Opposition (within ninety (90) days from the publication date)
• Substantive examination (to be requested within five (5) years from the publication date)
• Grant of the patent (grant fee to be paid within sixty (60) days of receiving Notice of Allowance)

Requirements

• Name, nationality and address of the applicant(s) and inventor(s)
  
• Patent specification including description, claims, abstract and drawing(s)
• Power of Attorney
• Deed of Assignment transferring rights of the invention from the inventor(s) to the applicant(s)
• Priority details (if any)
• Certified copy of Priority Document (if priority is claimed)
• A copy of the international application (PCT/RO/101) (for PCT route)
• PCT publication (for PCT route)
• Application should be filed in Thai

Grant & Maintenance

• Twenty (20) years from the filing date
  
• The first annual fee starts from the fifth (5th) year (should be paid within sixty (60) days from the beginning of the 5th year)

Remarks*

• Petty patent is available with validity term of ten (10) years from the filing date
  
• Thailand does not permit the filing of voluntary divisional applications. A divisional may only be filed in response to a unity of invention objection.
  
• Novelty grace period: twelve (12) months before first priority date or filing date

• Title and brief description of the design
  
• Claim of the design (1 only)
• Classification of the design in accordance with Locarno Classification
• Power of Attorney
• Statement justifying the applicant’s right if the applicant(s) is not the designer(s) /author(s)
• Right transferring letter if the applicant(s) is not the designer(s) / author(s)
• Priority details (if any)
• Certified copy of Priority Document (if priority is claimed)
• Application should be filed in Thai

Validity Term & Maintenance

• Industrial design registration is valid for ten (10) years from the date of filing
  
• The first maintenance fees must be paid at the beginning of the fifth (5th) year of the industrial design validity term
  

Remarks*

• Multiple design application is not allowed
  
• No provision for novelty grace period in the Thai design regulation
  

Legal Basis

• Sample of the work or creation (can be in the form of: printed materials, CD/USB (for software creation) and manual book)
• Name, nationality and address of the applicant(s) and the author(s) or creator(s)
• Type and title and brief descriptions of the copyright
• Permission to publish the copyright
• Filing of application
• Examination
• Acceptance of the application
• Electronic storage of the application
• Certificate of recordation
  Application should be filed in Thai

Protection Duration

• Life of the author plus fifty (50) years after the date of death of the last surviving author for a work of joint authorship
  
• Fifty (50) years from the date the work was lawfully made available to the public for anonymous or pseudonymous works
  
• Twenty-five (25) years from the date the work was created for applied art work
  

Remarks*

• Copyright protection is obtained automatically without any need for registration or other formalities
  
• Registration of copyright is in voluntary nature but can be recorded for the purpose of evidence of legal ownership
